EB-5 FAQ
Is the investment made at the parent Sustaino level or at the individual property level, such as Integrated Life or Vedic Village?
EB-5 investments are tied to individual properties. Each property is structured as its own LLC with a dedicated operating agreement. Investors become partners in the specific property, which typically includes organic farms, a farm resort with guest accommodations, and a community kitchen.
Where is the current EB-5 eligible property located?
6030 Baux Mountain Rd, Winston-Salem, NC
What is the size of the Vedic Village development?
The project spans 215+ acres of master-planned, eco-focused development.
What makes Winston-Salem, NC, a strong EB-5 investment location?
The region is experiencing rapid growth across housing, manufacturing, aviation, and logistics sectors, supporting strong job creation and infrastructure expansion.
Is this property located in a Targeted Employment Area (TEA)?
Yes, this property qualifies as being in a TEA.
How much do I need to invest and when?
The total EB-5 investment required for TEA-qualified projects is $800,000
Initial Investment: $400,000 (50%) is required upfront.
Remaining Balance: The other 50% will be contributed in stages throughout the green card process, as outlined by the immigration attorney. The second payment may be split into parts. At this stage, however, proof of funds for the full $800,000 is required.
What types of funds can be used for the investment?
You may use any of the following sources, subject to proper documentation and lawful sourcing requirements:
- Gifts from family or friends
- Personal savings
- Proceeds from stock sales
- Home Equity Line of Credit (HELOC)
- Retirement accounts (e.g., 401(k))
- Personal loans
Who is included in the EB-5 immigration benefits?
One EB-5 investment covers the principal applicant, spouse, and unmarried children under 21 under a single petition.
How does Sustaino Plan to Create Jobs?
Sustaino’s eco-communities are designed to generate sustainable, long-term employment through integrated, self-sufficient operations:
- Organic Farms: Farm managers, agricultural workers, produce handlers
- Farm Resort & Wellness Center: Hospitality staff, chefs, wellness instructors, maintenance teams
- Community Infrastructure: Administrative staff, event coordinators, landscaping, and security
Each community is projected to create 30–50 direct jobs, supporting EB-5 visa program requirements through meaningful and measurable employment.
What types of EB-5 investment options does Vedic Village offer?
Vedic Village offers Regional Center (RC) EB-5 investment pathway. A passive pooled investment through a USCIS-designated Regional Center.
What is a Regional Center EB-5?
Regional Center EB-5 is a pooled, passive investment structure administered by a USCIS-designated regional center. Job creation can be counted through indirect and induced jobs, allowing more flexibility and minimal investor involvement in day-to-day operations.
How many jobs will be created for EB-5 purposes?
We expect to create approximately 250 jobs across farming, hospitality, wellness, construction, community services, and operational roles. These jobs support the Regional Center EB-5 requirements.
How many EB-5 investors can the project accommodate?
We have capacity for 11 Regional Center investors based on project job-creation capacity and project structure.
What is the general immigration process for EB-5 investors in this project?
Investors invest funds, file Form I-526E, may apply for work authorization if adjusting status in the U.S., receive a conditional green card, and later file Form I-829 to remove conditions.
What is the current status of the Vedic Village project?
Infrastructure development for Vedic Village began in August 2025 and is progressing well. Roads, utilities, and grading are underway, with the first phase of home construction scheduled to begin in mid-2026. In addition, work on the organic farms and the farm resort is planned to begin in early 2026, creating both community amenities and sustainable employment opportunities.
What types of real assets are being developed at Vedic Village?
The project includes residential homes, organic farmland, a farm resort, wellness infrastructure, hospitality facilities, and long-term community amenities.
Why are investors choosing to start the EB-5 process now?
There are several reasons investors are acting now:
- Demand for EB-5 continues to increase, and future visa backlogs may develop as more investors enter the program.
- Rural and High Unemployment Area (HUA) visa categories are currently available for many nationalities, including India.
- Investors who file under the current law may benefit from grandfathering protections if future legislative changes occur.
- Concurrent filing may allow eligible investors already in the United States to obtain work and travel authorization while their Green Card application is pending.
What is EB-5 grandfathering and why does it matter?
The EB-5 Reform and Integrity Act provides protections for investors who properly file their petitions before future program changes.
In simple terms, once an investor files an eligible I-526E petition, they generally continue under the rules in effect at the time of filing, even if Congress later modifies the program.
This can provide additional certainty for long-term immigration planning.
Is the EB-5 priority date currently available?
At the time of writing, the Rural and High Unemployment Area set-aside categories remain current for many investors.
A current priority date means investors may proceed without waiting in a visa backlog. Since visa availability can change, many investors prefer to file while these categories remain current.
How much is the minimum EB-5 investment?
The current minimum investment amount is:
- $1,050,000 for non-TEA projects
- $800,000 for Targeted Employment Area (TEA) projects
For comparison, the minimum investment was $500,000 for qualifying projects prior to changes implemented by Congress.
Can I invest $400,000 now and complete the remaining $400,000 later?
Potentially, yes.
Many projects may consider accepting an initial partial investment if:
- The investor can document the lawful source of the full $800,000 investment.
- The remaining funds are contributed within a reasonable timeframe.
- The full investment amount is completed before USCIS adjudicates the I-526E petition.
Each case should be reviewed by the project team and the investor’s immigration attorney.
What are the advantages of an EB-5 project structured as senior debt?
In a senior debt structure, the EB-5 fund lends money to the project rather than investing as common equity.
Potential benefits include:
- Higher repayment priority compared to equity investors
- Defined loan terms
- Additional security and collateral arrangements
- Reduced reliance on future valuation growth
While all investments involve risk, senior debt is generally considered higher in the capital stack than common equity.
What is concurrent filing?
Investors who are already in the United States and otherwise eligible may be able to file:
- Form I-526E
- Form I-485 (Adjustment of Status)
- Form I-765 (Employment Authorization)
- Form I-131 (Advance Parole)
at the same time.
This process is known as concurrent filing.
When can I receive Employment Authorization (EAD)?
Eligible investors who file concurrently may receive Employment Authorization Documents (EADs) while their Green Card application is pending.
Typical processing times vary, but many applicants receive work authorization within approximately 3 to 8 months after filing.
What is Advance Parole?
Advance Parole allows eligible applicants to travel internationally and return to the United States while their Adjustment of Status application remains pending.
Advance Parole is typically filed together with the I-485 package.
What is a Conditional Green Card?
Once approved, EB-5 investors first receive conditional permanent residence.
The conditional Green Card provides the same rights as a permanent Green Card, including:
- Living permanently in the United States
- Working for any employer
- Operating a business
- Traveling freely
The conditional period generally lasts approximately two years.
When do I receive a permanent Green Card?
Near the end of the conditional residence period, investors file Form I-829 to demonstrate that program requirements have been satisfied.
Upon approval of the I-829 petition, the conditions are removed and the investor receives permanent lawful permanent resident status.
What is a typical EB-5 timeline?
A general timeline may look like:
Month 0
- Investment completed
- I-526E filed
Months 3–8
- Employment Authorization (EAD)
- Advance Parole (AP)
Months 12–36+
- Conditional Green Card approval
Approximately 2 years after conditional residence begins
